In what has now become a firm tradition, on November 28th, Eric Glazer had the honor of addressing the United States Supreme Court, requesting that the associate attorneys at Glazer and Associates be granted admission to The Bar of the United States Supreme Court. The Chief Justice John Roberts granted the motion.

Eric Glazer is the first attorney in the State to design a course approved by the Florida Department of Business and Professional Regulation, which allows him to certify people who wish to serve on a condominium board of directors. Since the Florida Legislature mandated that Board members become certified, Eric has certified over 2,000 people. Remember that as of July 1st, 2011 one way that a person can get certified is by attending a course within one year before being elected to the Board or within 90 days of having actually been elected. Moreover, recertification is not required if the director serves on the board without interruption. Keep in mind that legislation has recently been proposed which will require HOA Board members to become certified as well. Here is a list of our upcoming seminars:

  • Orlando: February 18th at noon at The Hard Rock Hotel;
  • West Palm Beach: February 29th at 3:00 at the South Florida Fairgrounds at PM-Expo;
  • Punta Gorda: March 27th at 9:30 a.m. at the Charlotte Harbor Event & Convention Center at PM-Expo;
  • Hollywood: April 5th, 7:00 p.m. at The Hard Rock Hotel and Casino.

On February 11th, 2011 Eric Glazer had the honor of arguing one of the most important condominium law cases to be heard by the state's top court in nearly a decade. In Cohn v. The Grand Condominium the Florida Legislature passed an amendment to the Florida Condominium statutes that allowed the residential unit owners to elect a majority of their Board if the residential units outnumber the commercial units, even where the bylaws state otherwise. The Florida Supreme Court held that if a condominium's declaration does not contain words to the effect that it automatically adopts changes to the Condominium Act as they occur "from time to time" the new laws do not apply to the condominium because it would be unconstitutional to do so. Since The Grand's declaration did not contain these words, the residential unit owners were out of luck. Do your documents contain these magic words? If you would like to watch the actual oral argument and get a peek into the workings of The Florida Supreme Court, just visit the firm's website.
